The Legal Hotspots Hiding In Your Offer

if you don’t make it crystal clear what your offer isn’t—you might be making promises you didn’t intend TO MAKE.

Whether you’re blurring the lines of support versus advice or using some stellar testimonials to sweeten your offer, one thing is certain:

You could have accidental, hidden legal promises all over your promotional content.

And yeah, that means strategically (and properly) using some disclaimers.

Not the boring kind. Not the copy-paste-from-ChatGPT kind.

I’m talking about disclaimers that are legally sound and energetically clean.

I’m Maria Spear Ollis, aka The Lunar Lawyer, and I’m going to shine some light on the legal hotspots hiding in your offer.

What is a disclaimer?

A disclaimer is a short little cover-your-booty statement. I like to compare disclaimers to the “wet floor” sign (and your business is the grocery store in that scenario).

It’s a sentence or two that’s part boundary-builder, part liability-protector.

It might say something like:

  • “I am not a licensed medical provider and this program doesn’t replace therapy.”

  • “Outcomes are dependent on you and your level of participation.”

  • “The links in this email are affiliate links.”

And yes, when used correctly, they can really save your butt.

What’s the difference between a disclaimer and a contract?

Basically, a disclaimer is a warning thats fairly one-way: you’re making the statement to put someone on notice. Compare that to a contract, which is a document that binds two people to mutually-agreed-upon promises.

I went into detail on the differences in this post.

Why disclaimers matter

Disclaimers do three things:

  1. THEY set expectations.

  2. THEY protect your boundaries.

  3. THEY help you stay in your zone of genius—without overpromising or overextending.

But the type of disclaimer will depend on:

  1. The format we’re dealing with (a sales page vs. a promotional email vs. a social media post); and

  2. What you’re saying.
